References to “Velocitas”, “we”, “us”, and “our” are references to FirmSwitch Ltd.
The terms “you” and “your” refer to any individual, company, or business to whom we provide Services, including any person reasonably appearing to us to act with your authority.

2. Use of Our Site
Your use of our site is governed by our Website Terms of Use. Please read these carefully as they contain important terms applicable to you.
3. How We Use Your Personal Information
We only use your personal information in accordance with our Privacy Policy.
Velocitas utilises FraudRecord to screen new orders for previous fraudulent activity and may report existing clients who violate these Terms. In the event of a violation, you may be reported to FraudRecord using one-way hashed information.
4. Our Contract With You
These Terms and any documents expressly referred to within them constitute the entire agreement between you and us ("Contract").
You acknowledge that you have not relied on any statement, promise, or representation not expressly set out in these Terms.
Where you are a consumer, your statutory rights remain unaffected.
5. How the Contract is Formed
After placing an order, you will receive an email acknowledging receipt of your order. This acknowledgement does not constitute acceptance.
The Contract is formed only when we issue an Order Confirmation email.
If we are unable to supply the Services ordered, we will notify you and refund any monies paid where applicable.
6. Our Right to Vary These Terms
We may revise these Terms from time to time, including due to:
- changes in payment methods;
- changes in laws or regulations;
- operational or security requirements.
The Terms in force at the time of your order will apply to your Contract.
7. Providing Services
We will provide the Services from the start date specified in the Order Confirmation until termination in accordance with these Terms.
We may require certain information from you to provide the Services, including identity verification documents where necessary. Failure to provide requested information may result in delays, suspension, or cancellation of Services.
You are responsible for obtaining:
- suitable third-party software licences; and
- any required permissions or consents.
We may suspend Services due to technical issues, maintenance, security concerns, abuse reports, or unpaid invoices.
Failure to pay invoices within 7 days of the due date may result in suspension of Services until all outstanding balances are settled.
Implementation and Transition
Where requested, we will use reasonable endeavours to assist with migration or transfer of websites and hosting environments.
Shared Hosting
Where Services include shared hosting, we will provide hosting resources on a shared server environment.
You warrant that Hosted Materials will not:
- violate any applicable laws or regulations;
- infringe intellectual property rights;
- contain defamatory, abusive, threatening, fraudulent, or malicious content;
- promote illegal activity; or
- contain malware, phishing tools, or harmful software.
Adult content is permitted only where lawful and compliant with all applicable regulations.
We reserve full administrative control over shared hosting environments and may modify configurations where necessary for operational stability or security.
Dedicated Servers & VPS
Dedicated servers and VPS services are supplied according to the specifications advertised on our site.
For unmanaged services, you acknowledge that you are solely responsible for server administration, configuration, and security.
We reserve the right to suspend any VPS or server that:
- negatively impacts network stability;
- excessively consumes shared resources;
- is used for spam, phishing, malware, illegal content, or abusive activity.
Fair Usage Policy
MicroKVM VPS services may not exceed 50% CPU utilisation continuously for longer than one hour within any 24-hour period.
Other VPS services may not exceed 75% CPU utilisation continuously for longer than two hours within any 24-hour period.
Where excessive usage impacts other users, we reserve the right to temporarily suspend the affected service.
Email Restrictions
Outbound SMTP ports (25, 465, and 587) may be blocked by default to prevent spam and abuse.
Requests for removal of these restrictions may be denied at our sole discretion.
Colocation Services
Where Services include colocation, we will provide rackspace, power, cooling, and network connectivity as agreed.
Clients remain responsible for their own equipment, software, licensing, and physical security practices.
Velocitas shall not be liable for loss or damage to customer equipment except where caused directly by our gross negligence or wilful misconduct.
Equipment left uncollected more than 60 days after termination may be disposed of or sold to recover outstanding costs.
Email Services
Where Services include email hosting:
- we will provide POP3, IMAP, SMTP, and webmail access where applicable;
- spam and antivirus filtering may be applied;
- mailbox storage limits apply;
- sending spam, bulk unsolicited email, or abusive mail is prohibited.
Domain Name Registration
Where the Services we provide to you include domain name registration, renewal, transfer, or management services, the following terms shall apply.
We will attempt to register domain names requested by you using the details supplied during the ordering process, however we do not guarantee that any requested domain name will be available or successfully registered.
You warrant that:
- all information supplied for the purposes of domain registration is accurate, complete, and up to date;
- you are legally entitled to register and use the requested domain name;
- the registration and use of the domain name will not infringe the rights of any third party; and
- you will maintain accurate registrant contact details at all times.
The registered domain holder is ultimately responsible for ensuring compliance with all applicable registry rules and policies.
Nominet Terms and Conditions
For all .uk domain registrations, renewals, and transfers, you agree to be bound by the applicable Nominet Terms and Conditions, Registrant Policies, and Dispute Resolution Service Policies in force at the time of registration.

By submitting an order for a .uk domain name, you confirm that you have read, understood, and accepted the applicable Nominet terms and policies.
Acceptance of these terms forms part of the registration process and may be recorded for compliance and audit purposes.
For non-.uk domains, registrations are additionally subject to the applicable policies and rules of the relevant registry operator and ICANN where applicable.
Charges for Domain Name Services
Pricing for domain registration, renewal, transfer, restoration, and related services is published on our website and may change from time to time.
All domain-related charges are payable in advance unless otherwise agreed in writing.
Domain registration, renewal, redemption, and transfer fees are non-refundable once processed.
Domain Expiry and Renewal
It is your responsibility to ensure that domain names are renewed before their expiry date.
We may send renewal reminders as a courtesy using the contact details associated with your account, however we do not guarantee delivery or receipt of renewal notices.
Where automatic billing is enabled, renewal fees may be automatically collected using the payment method saved on your account.
Failure to renew a domain name before its expiry date may result in:
- suspension of associated services;
- interruption to website or email functionality;
- the domain entering a grace, redemption, or suspension period;
- additional restoration or redemption fees;
- permanent loss of the domain name; or
- the domain becoming available for registration by third parties.
Velocitas accepts no liability for any loss, damage, business interruption, or consequential losses arising from expired or unrecovered domain names.
Domain Transfers
You may transfer your domain name registration to another registrar in accordance with applicable registry procedures.
Velocitas does not charge fees for transferring .uk domain names to another registrar unless additional administrative work outside standard registrar procedures is required.
Certain non-.uk domain extensions may incur transfer, renewal, or registry-imposed fees.
All outstanding balances relating to your account or Services must be paid before transfers are processed.
We reserve the right to refuse or delay transfer requests where required by applicable law, registry policy, fraud prevention requirements, abuse investigations, or unresolved payment disputes.
Domain Suspension and Abuse
We reserve the right to suspend, cancel, refuse, or modify domain-related Services where required by:
- applicable laws or regulations;
- registry or registrar obligations;
- abuse complaints;
- fraud prevention requirements; or
- violations of these Terms.
Abuse reports may be submitted to:
We may cooperate with law enforcement agencies, Nominet, ICANN, registry operators, or other competent authorities in connection with investigations relating to domain abuse, fraud, phishing, malware, spam, or unlawful activity.
SSL Certificates
Where Services include SSL certificates, we will attempt to provision certificates through approved providers.
Clients remain responsible for the management and renewal of third-party SSL certificates where self-managed access is provided.
Backups and Data Retention
While Velocitas may, at its sole discretion, maintain backups or snapshots of certain Services for operational or disaster recovery purposes, we do not guarantee the existence, availability, accuracy, completeness, or restorability of any backups.
You acknowledge and agree that:
- you are solely responsible for maintaining independent and up-to-date backups of all data, websites, databases, emails, configurations, and Hosted Materials;
- backup systems provided by us, whether paid or complimentary, are provided on a best-efforts basis only;
- we do not guarantee that backups will be available, recoverable, error-free, or suitable for any specific purpose;
- restoration requests may be refused, delayed, incomplete, or subject to additional charges at our discretion.
To the fullest extent permitted by law, Velocitas shall not be liable for any loss of data, corruption, deletion, failed restoration, incomplete backup, or inability to recover Hosted Materials for any reason whatsoever, including hardware failure, software failure, user error, malicious activity, or Events Outside Our Control.
Clients are strongly advised to maintain separate off-site backups at all times.
Support
We will use reasonable endeavours to respond to support requests promptly.
All support requests will be acknowledged within 24 hours where reasonably practicable.
Any illegal activity, phishing, spam, abuse, or malicious conduct may result in immediate suspension or termination without notice.
8. Intellectual Property Rights
You retain ownership of all intellectual property you provide to us.
You grant us a licence to use such intellectual property solely for the purpose of providing the Services.
All intellectual property created by us in connection with the Services remains our property unless otherwise agreed in writing.
9. Problems With the Services
If there is a defect or issue with the Services, please contact us via the helpdesk as soon as reasonably possible and provide detailed information regarding the issue.
We will use reasonable endeavours to investigate and resolve issues promptly.
Nothing in these Terms affects your statutory rights.
10. Complaints Procedure
If you are dissatisfied with any aspect of the Services provided by Velocitas, you may submit a formal complaint in writing to:

- any supporting evidence.
We will acknowledge receipt of complaints within a reasonable timeframe and will use reasonable endeavours to investigate and respond promptly.
Submission of a complaint does not suspend your payment obligations unless agreed otherwise in writing.
Abusive, threatening, or offensive behaviour directed toward staff may result in suspension or termination of Services.
11. Price of Services
Prices are as listed on our site and may change from time to time.
Prices exclude VAT where applicable.
Domain registrations, renewals, and SSL certificate purchases are non-refundable.
12. Payment
Payment must be made in advance via approved payment methods.
You authorise us to automatically collect recurring payments using any saved payment method on file.
Late payments may incur a fixed late fee equal to the greater of:
- 3% of the overdue amount; or
- £5.00
Failure to pay may result in suspension or termination of Services.
13. Termination
Either party may terminate the Contract:
- for material breach not remedied within 28 days;
- immediately where unlawful activity occurs;
- immediately for abusive conduct toward staff; or
- with 30 days written notice unless a fixed-term service applies.
No refunds will be issued for annual or prepaid services cancelled before expiry unless otherwise required by law.
14. Consequences of Termination
Upon termination:
- Services will cease;
- access to hosted systems may be removed;
- outstanding invoices remain payable.
Where applicable and technically feasible, we may provide copies of hosted materials upon request.
We may cooperate with law enforcement where legally required.
15. Our Liability (Business Customers)
Nothing in these Terms excludes liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any liability which cannot lawfully be excluded.
Subject to the above, we shall not be liable for:
- loss of profits;
- loss of revenue;
- loss, corruption, deletion, inaccessibility, or failed restoration of data, backups, systems, or Hosted Materials;
- loss of goodwill;
- indirect or consequential losses.
Our total liability shall not exceed the amount paid for the affected Services during the preceding 12 months.
16. Our Liability (Consumers)
Nothing in these Terms excludes liability that cannot legally be excluded.
Subject to this, our liability shall be limited to foreseeable losses directly caused by our breach.

17. Indemnity
You agree to indemnify and hold harmless Velocitas against claims, damages, liabilities, losses, and expenses arising from:
- your misuse of the Services;
- your breach of these Terms; or
- infringement of third-party rights.
18. Events Outside Our Control
We are not liable for delays or failures caused by circumstances beyond our reasonable control including:
- natural disasters;
- war;
- terrorism;
- industrial disputes;
- power failures;
- internet outages;
- telecommunications failures;
- governmental actions.
19. Communications
Notices may be given by email or post.
Formal notices to Velocitas should be sent to:

20. Data Protection

21. Other Important Terms
These Terms constitute the entire agreement between the parties.
If any provision is found unenforceable, the remaining provisions remain valid.
Failure to enforce any right shall not constitute a waiver.
These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
Calls may be recorded for training, quality assurance, and security purposes.
Our DDoS protection is provided on a best-efforts basis and we do not guarantee uninterrupted availability during exceptionally large attacks.
22. Money Back Guarantee
New customers may request a refund for eligible hosting services within 30 days of purchase by submitting a cancellation request through the client area.
Refunds do not apply to:
- domain registrations;
- SSL certificates;
- software licences;
- third-party services;
- completed professional services.
We reserve the right to deduct payment gateway or processing fees where applicable.
Eligibility for refunds is determined at our sole discretion and abuse of the guarantee may result in refusal.
